<p>2002 年國內音樂產業提告全球數碼科技公司（Ezpeer）違法侵權案， 經士林地方法院於 2005 年 6 月 30 日下午四時宣判（註一）。判 決主文僅列兩條結論，就是「Ezpeer 負責人無罪，全球數碼科技股 份有限公司不罰。」</p>
<p>在訴訟尚未終局前，論定是非尚言之過早，但此案同時點破一個主題， 就是 P2P（Peer to Peer）這樣新式的檔案傳輸模式，確實對現行的 著作權架構產生了一定的衝擊和影響。或者這麼問：隨著科技的發展， 現行的著作權架構將面臨如何的挑戰？</p>

<p>Perseus Development 日前於 MediaPost 發表的報告指出，BlogSpot 、LiveJournal、Xanga 與 MSN Spaces 等服務，已有 3160 萬個 Blog 其中，在 2005 年第一季出現的 Blog 就有 1000 萬，預計到 2005 年底，將可成長至 5340 萬個 Blog。Perseus 表示 BlogSpot、LiveJournal、Xanga 為此類服務的領導業 者，BlogSpot 擁有 800 萬個 Blog 帳號。以 14 種語言在 26 個市 場發表的 MSN Spaces 擁有 450 萬個帳號，來勢洶洶。TypePad、 Blurty、Greatest Journal、AOL Journals 成長快速，其中以 TypePad 最為成功。此外，Perseus 指出 AOL 將推出針對青少年的 Blog 服務。 在主流 Blog 服務之外，Dead Journal 與 Diaryland/Pitas 則以獨 特取向著稱。Dead Journal 標榜提供並不討好的 Blog，讓人專門用 來記錄私人的咆哮不滿與難以啟齒的想法。Diaryland 則強調簡單清 爽的界面設計風格。</p>

<td style="font-size: 12px; color: #444444; line-height: 200%;">開放源碼軟體，在社群以及推廣單位的助陣下，有愈來愈多的人將開 放源碼拿來作專案的應用服務，以筆者這兩三年在一些專案外包網站 的觀察，尤其以近半年，開放源碼軟體需求案件有急劇的增加，有的 公司甚至指明要用哪一套開放源碼軟體或是使用某些開放源碼的標準 來做專案的開發，然而令人憂心的是，這些相關的開放源碼專案委外 的價格都相當的低廉，許多的專案甚至都在一萬元以下，但是依然有 許多的團隊或是個人工作室搶破頭去承接。</td>
